Delhi Ordinance: Hearing in the Supreme Court on the ordinance of the Center, the matter can be assigned to the constitution bench

Delhi Ordinance 2023: A hearing was held in the Supreme Court on Monday regarding the central government’s ordinance on transfer posting of officers in Delhi. During this, CJI DY Chandrachud said that we want to hand over the ordinance that takes the services out of the control of the Delhi government to the constitution bench. So far only three subjects were outside the purview of the Delhi government.

He said that it needs to be seen whether any new subject can be added to this list like this. On this, Delhi government’s lawyer Abhishek Manu Singhvi said that I do not think that there is a need to send the matter to the constitution bench. I would like to have a side on this on Thursday. 

The Aam Aadmi Party government of Delhi had filed a petition in the Supreme Court against the ordinance of the Center. The petition also challenges the LG’s decision to appoint the DERC chairman without the consent of the Delhi government.

During the hearing in the court, the Solicitor General said that after this there is a hearing on the ordinance as well. This matter is also related to him. In the Parliament session starting from July 20, the new ordinance of the Center related to Delhi will be presented in the form of a bill. Efforts will be made to get it passed by the Parliament. Till then it would be better to wait. The Supreme Court has adjourned the hearing of the case to July 20.
